These Terms of Service ("Terms") apply to your use of shesgotclarity.com, our workshops, coaching, content, and any other services we offer (together, the "Services"). She's Got Clarity is owned and operated by [She's Got Clarity, LLC), based in Austin, Texas ("we," "us," "our").

By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

1. What We Do (and Don't Do)

She's Got Clarity teaches women how to use AI tools - like ChatGPT, Claude, and other platforms - as a smarter thinking partner for their health, mindset, and life.

We are an education and training company. We help you learn how to give AI the right personal context so it can give you better, more useful answers.

We do not provide medical, psychological, legal, financial, or professional advice of any kind. Nothing we share in workshops, coaching, on the website, in emails, or through any AI tools we teach you to use is intended as a substitute for advice from a licensed professional.

2. Health Disclaimer (Please Read This Carefully)

Our content focuses on midlife women's health, including perimenopause, menopause, supplements, nutrition, fitness, and related topics. Here's what you need to know:

• We are not doctors, nurses, dietitians, therapists, or licensed health professionals. Misty Gibbs and the She's Got Clarity team are educators, not clinicians.

• Nothing on this site or in our Services is medical advice, diagnosis, or treatment. Educational content — including stories Misty shares about her own health — is for informational purposes only.

• Always consult a qualified healthcare provider before starting, stopping, or changing any supplement, medication, diet, exercise program, or treatment plan. Your provider knows your full medical history; we don't.

• In an emergency, call 911 or your local emergency services. Do not rely on the Services or AI tools for emergency medical guidance.

• You are responsible for your own health decisions. AI is a tool that can help you think and ask better questions. It does not replace your judgment, your doctor, or your responsibility to make informed choices for yourself.

We chose this work because we believe women deserve better information and a smarter way to make sense of it. But the call is always yours — and your doctor's.

3. About AI Tools

We teach you how to use third-party AI tools, including but not limited to ChatGPT (OpenAI), Claude (Anthropic), and other platforms. Here's how that works:

• We don't own, operate, or control these AI tools. When you use them, you're using a separate service governed by that company's own terms and privacy policies. Please read theirs.

• AI tools can be wrong. AI can generate inaccurate, incomplete, outdated, or misleading information — especially on health, medical, financial, and legal topics. A peer-reviewed study found AI tools correctly identified user health conditions only about a third of the time when users didn't provide proper context. Even with the best context, AI makes mistakes. Always verify important information with qualified professionals.

• What you share with AI is your responsibility. We teach privacy-aware practices, but anything you type into a third-party AI tool may be processed, stored, or used by that company according to their policies. Don't share information you wouldn't want a third party to have.

• We're not responsible for AI outputs. We can't guarantee what any AI tool will say to you or how accurate it will be. You agree that any decisions you make based on AI output are your own.

The core message of She's Got Clarity is this: AI does the research. You make the call. That's not just a tagline — it's how we want you to use these tools.

4. Workshops, Coaching, and Paid Services

When you purchase a workshop, coaching session, or other paid Service, you agree to the following:

Payment

All prices are listed in U.S. dollars. Payment is due at the time of purchase. By providing payment information, you authorize us (and our payment processor) to charge the listed amount.

No Refunds

All workshop, coaching, and product purchases are final and non-refundable. Please review the offer description carefully before purchasing. By completing a purchase, you confirm that you understand and accept this no-refund policy.

If you are unable to attend a live workshop, you will receive access to the recording (when available) but no refund will be issued.

We reserve the right to reschedule or cancel a workshop. If we cancel a workshop and cannot offer a reasonable replacement date or recording, we will issue a refund for that specific session at our discretion.

Access and Use

Paid content is for your personal use only. You may not share login credentials, recordings, materials, or paid content with anyone else. You may not record, reproduce, redistribute, or sell our content.

Conduct

We reserve the right to remove anyone from a workshop, coaching session, or the Services who is disruptive, abusive, or violates these Terms. No refund will be issued for removal due to conduct.

5. Intellectual Property

Everything on the Services including the She's Got Clarity name, logo, methodology (including the AI Clarity Profile), frameworks, advisor team concept, written content, course materials, workshop content, prompts, templates, images, and design — is the property of She's Got Clarity and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may:

• View, share, and link to our public content (blog posts, social media, free resources)

• Use our prompts and frameworks in your own personal AI work

You may not:

• Copy, reproduce, redistribute, sell, or commercially use our paid content, methodology, or materials

• Use our brand name, methodology, or framework to teach, coach, or sell your own competing service

• Claim our methodology or content as your own

6. Your Content

If you submit content to us - comments, testimonials, questions, feedback, photos, or anything else - you grant us a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with the Services and our marketing. We will never share your personal health information without your explicit permission.

You confirm that anything you submit is your own and doesn't violate anyone else's rights.

7. Privacy

Our Privacy Policy explains how we collect, use, and protect your information. By using the Services, you agree to our Privacy Policy.

8. Third-Party Links and Services

The Services may include links to third-party websites, tools, or services (including the AI platforms we teach you to use). We don't control or endorse these third parties and aren't responsible for their content, accuracy, terms, or practices. Use them at your own discretion.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY INFORMATION (INCLUDING AI OUTPUTS) WILL BE ACCURATE, COMPLETE, OR CURRENT.

YOU USE THE SERVICES AT YOUR OWN RISK.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SHE'S GOT CLARITY, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR ANY AI TOOLS WE TEACH YOU TO USE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless She's Got Clarity, its owners, employees, contractors, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your use of AI tools or AI outputs; (c) any health, medical, financial, or other decisions you make based on the Services; (d) your violation of these Terms; or (e) your violation of any third-party rights.

12. Account Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason — including violation of these Terms. You may stop using the Services at any time.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top. Material changes will be communicated by email or on the Services. Your continued use after changes means you accept the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Travis County, Texas, and you consent to the exclusive jurisdiction of those courts.

15. Miscellaneous

• Entire Agreement: These Terms (together with our Privacy Policy and any purchase-specific terms) are the entire agreement between you and us regarding the Services.

• Severability: If any part of these Terms is found unenforceable, the rest remains in effect.

• No Waiver: Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.

• Assignment: You may not assign these Terms. We may assign them to a successor or affiliate.
